The Claim Process
As a knowledgeable Pittsfield discrimination claim attorney, I will handle your case at every stage, including:
- Choosing where to file: In Massachusetts, you can file either a state or a federal discrimination claim. For state claims, you file with the Massachusetts Commission Against Discrimination (MCAD). Federal claims are filed with the U.S. Equal Employment Opportunity Commission (EEOC). It is often preferable to file with MCAD, since the commission will file jointly with the EEOC. Also, state law is generally more favorable to employees than federal law.
- Filing the claim: When you file your employee discrimination claim, you include a complaint, which I will prepare for you. It will provide the factual basis for your claim, detailing the type of discrimination you are claiming and the facts.
- Employer's response: After you file you claim the employer will file a response, typically within 21 days. This is called a position statement.
- Rebuttal or removal: After the employer has responded, either you can file a rebuttal to the employer's response or you can choose to remove the case to superior court. Removing the case to superior court is often beneficial because MCAD and the EEOC are overwhelmed with claims and can take up to two years to reach a decision.
